Civil Law refers to a body of laws that deal with disputes between individuals, organizations, or both. It governs issues related to private rights and obligations, unlike criminal law, which deals with offenses against the state.
1. Purpose of Civil Law:-
Civil law aims to resolve non-criminal disputes, ensuring fairness and justice in issues such as contracts, property, family matters, and personal rights. The goal is usually to provide compensation or enforce rights rather than punishment.
2.Examples of Civil Law Cases:-
- Contract Disputes: If one party fails to honor an agreement.
- Property Disputes: Ownership or boundaries of property.
- Family Law Issues: Divorce, child custody, inheritance.
- Torts Personal injury or defamation
3. Standard of Proof:-
Civil law cases are decided on a "balance of probabilities," meaning the judge or jury will decide in favor of the side that seems more likely to be correct, as opposed to "beyond a reasonable doubt" in criminal cases.
4. Outcome:-
If the plaintiff wins, they may receive a)compensation or b)specific performance (i.e., the defendant must fulfill a legal duty).
